MINUTES


Commissioners Present: Chairman Stephen Smith, Steven LaBranche, Linda Haspel, Vivien Cook and Michael Harnett.

Commissioners Not Present: Fred Rollinson.

Staff Present: Jeff Thibodeau, Shana Brogan.

Also Present: John O’Reilly of JM O’Reilly, Ezra Ambrose of Ambrose Homes, Sarah Torrono-Flores, Jason Ellis of JC Ellis Design.

6:00PM Stephen Smith opened the meeting.

Notice of Intent filed by Jacqueline and Mark Breton. Applicant proposes replacement of pier foundation with full foundation, construction of addition and installation of a septic system driveway relocation at property located at 30 Longstreet Lane, Map 10 Parcel 363.
John O’Reilly of JM O’Reilly represented the project. He informed the commission the project proposes to remodel the existing house that is currently supported by concrete blocks and posts, a full foundation is proposed and they are working within the 50’ buffer of a coastal dune. He also said they will relocate the driveway, the driveway is proposed to be re-graded and the limit of work will be silt fence. John O’Reilly also noted the flood plain does not come into the back of the property and he does not believe it is within the flood plain. It was noted that work is generally not allowed within the 50’ buffer zone and there is a lot to the project that warrants mitigation plantings. John O’Reilly said they will replicate they will add what is there. Stephen Smith requested notes on what the construction details for the patio. John O’Reilly noted there will be a dry-laid patio.

6:25PM
Notice of Intent filed by Michel and Mary Jean Thompson. Applicant proposes construction of footpath to Great Pond at property located at 4 Atwood Lane, Map 11 Parcel 196C.
Tim Brady represented the project and explained it entails creation of a walking path from Atwood Lane.  The present deeded right of way path is abandoned and overgrown and a new easement will be created. No trees will be taken down for the pathway, and no clearing to be done - only some trimming. It was also noted that no one will be doing anything on the previous path once the path is approved. 4’ wide maximum and the path would wind its way around the trees only by pruning. As many as 3 or 4 properties would be using the pathway. Bob Mumford from 55 Clark’s Point Road addressed the commission and said the owners have not demonstrated they own the path. Stephen Smith stated no hardening, no surface, underneath is permitted and the path is to wind around the existing wider trees.

Continuation of Notice of Intent filed by Mary Jane and Frans Cramer. Applicant proposes 1.) lifting dwelling onto open pile foundation with associated access stairway, 2.) construction of two additions, 3.) deck expansion and deck additions with associated stairway, 4.) addition to existing garage and associated elevated walkway,  5.) elevated beach access walkway and 6.) septic system installation at property located at 325 Harmes Way, Map 01, Parcel 109.
Sarah Torrono – Flores representing the applicant said that Natural Heritage requested work be completed prior to April 1st however they wanted to complete the project though the summer and worked with Natural Heritage and Endangered Species Program to develop a protocol they would agree with to allow work in the summer. The applicant submitted an alternatives analysis, and a phased construction protocol. The applicant is amenable to adhering to the pressure treated wood policy and will show receipts of the materials they use. The applicant said they tightened work limit. The house is within the V-zone and A-zone and the proposed project was designed to conform to V-zone regulations. As a result of recent discussions with Natural Heritage and Endangered Species Program, a turtle protection plan and monitoring plan was submitted to the commission. Light penetration calculations were submitted and they would have a pre-construction plant inventory, and the applicant noted the septic system installation to be held off from until September. Turtle protection silt fencing to keep the turtles from the site to be installed by May 1st. The proposed boardwalk work would take place after November 15th. Monthly monitoring reports would be submitted to the commission. Stephen Smith commented that the gate for the turtle fencing should be closely monitored by all contractors to ensure it is closed. Jeff Thibodeau commented on the alternatives analysis and Jeff Thibodeau said the commission has not yet received a determination letter and the commission could take more time to review the alternatives from Natural Heritage and therefore the commission did not vote on the project.

7:15PM
Continuation of Notice of Intent filed by Ralph Belford. Applicant proposes removal of existing dwelling, construction of dwelling and installation of septic system at property located at 700R Ocean View Drive Map 24, Parcel 005.
Gordon Peabody and Peter Coneen represented the project. The commission did not vote on the project at the last meeting due to no DEP file number issuance.
Vivien Cook MOVED to approve, Michael Harnett SECONDED.

Conservation Administrator’s Report
Water management committee to come to the Conservation Commission scheduled meeting on March 26, 2013 to speak to the commission.  

Preliminary Eastham Wetlands Bylaw discussion regarding possible bylaw amendments and regulations.
Peter Wade requested to speak with commission about pressure treated wood. Stephen Smith commented he learned of a saw mill in Marshfield.
The commission agreed to move discussion to April 9, 2013.

Requests for Administrative Review

Removal of three pine trees near Great Pond leaning as result of recent storms. To be flush cut.

Nauset Haven on Minister’s Pond Cottages
Fallen tree on pond bank.
ALL IN FAVOR of approval.
The commission agreed a site visit is necessary to address drainage problems at the site and what the owners intend to do to.

40 Smith Heights Way
Storm tree removal on garage
ALL IN FAVOR of approval.

20 Derks Drive
Remove uprooted pine tree and two that were broken in a recent storm.
ALL IN FAVOR of approval.
